H-1B Cap Gap: What Happens When Your OPT Expires

What Is the H-1B Cap Gap?

The cap gap is the period between when your F-1 OPT work authorization expires and when your H-1B status begins on October 1. If you are selected in the H-1B lottery but your OPT expires before October 1, you would normally have no work authorization during that gap. The cap-gap provision automatically extends your F-1 status and OPT employment authorization through September 30 to bridge this period.

Who Qualifies for Cap Gap

You qualify if you are in valid F-1 status, your employer filed a timely H-1B cap-subject petition requesting a change of status, and you have been selected in the H-1B lottery. The extension applies automatically — you do not need to file anything separate. Your DSO should update your SEVIS record to reflect the cap-gap extension.

What If You Are Not Selected?

If you are not selected in the H-1B lottery, your OPT expires on its original end date with no cap-gap extension. Options include applying for STEM OPT extension (24 additional months if eligible), trying again in next year's lottery, exploring O-1 visa alternatives (no cap, no lottery), pursuing EB-2 NIW to self-petition for a green card directly, or departing the U.S. and working abroad while maintaining H-1B lottery eligibility. Working During the Cap Gap

If your cap-gap extension is based on an approved or pending change of status H-1B petition, you can continue working for your OPT employer under the automatic extension. If the H-1B petition is denied or withdrawn, the cap-gap extension terminates immediately and you must stop working. Keep your I-20 with the cap-gap notation and your H-1B receipt notice (I-797C) with you as proof of authorization.

Timeline tip: The cap-gap only extends through September 30. On October 1, you transition to H-1B status. Make sure your employer has your H-1B approval notice before October 1 so payroll and I-9 can be updated. If your H-1B is still pending on October 1, you can continue working under the cap-gap until a decision is made.
