Can USCIS Waive Your Green Card Interview?

Yes. USCIS has discretion to waive the in-person interview for certain I-485 adjustment of status cases. While USCIS expanded interview requirements in 2026, some categories still regularly have interviews waived β€” meaning your green card is approved without you ever appearing at a USCIS office.

Who Gets Interviews Waived?

Interview waivers are most common for employment-based cases (EB-1, EB-2, EB-3) where the I-140 was already approved and there are no red flags, cases where the applicant was previously interviewed for another benefit, children included as derivatives on a parent's I-485, and cases with overwhelming documentary evidence and no derogatory information. Marriage-based cases almost never have interviews waived due to the fraud detection component of the Stokes interview.

What Happens Instead of an Interview

If your interview is waived, USCIS adjudicates your case based on the documents you submitted with your I-485 package. An officer reviews your application, supporting evidence, background check results, and medical exam (Form I-693). If everything is in order, you receive an approval notice and your green card is mailed. If the officer has questions, they may issue a Request for Evidence (RFE) or schedule an interview after all.
