The Employment Authorization Document (EAD), obtained through Form I-765, is the work permit that allows eligible noncitizens to work legally in the United States. Processing times vary significantly by category β€” and in 2026, delays are worsening across many categories.

Current Processing Times (2026)

Adjustment-based EAD (c)(9): 3–8 months. H-4 EAD: 6–12+ months. OPT/STEM OPT: 2–5 months. Asylum-based (c)(8): Variable, affected by proposed rule changes. Premium processing ($1,780) available for some categories.

Auto-Extension Rule

If you file a timely EAD renewal (before your current card expires) in the same eligibility category, your existing EAD is automatically extended for up to 540 days from the expiration date. This prevents work authorization gaps during processing. Carry your expired EAD, receipt notice, and Form I-797C as proof of the extension.

Premium Processing

Premium processing ($1,780) is available for certain I-765 categories, guaranteeing a response within 30 business days. Not all EAD categories qualify.
