H-1B to Green Card Timeline: How Long It Takes

The Complete H-1B to Green Card Timeline

The H-1B to green card pathway is the most common route for employment-based permanent residence in the United States, but the timeline varies enormously depending on your country of birth and preference category. Here is a realistic timeline for 2026.

Step 1: PERM Labor Certification (6-18 months)

The process begins with your employer filing a PERM labor certification with the Department of Labor. The prevailing wage determination alone takes 6-8 months in 2026. After that, the employer conducts 30-60 days of recruitment, then files the ETA-9089 application. DOL processing currently takes 4-8 months. Total PERM timeline: approximately 12-18 months from start to approval.

Step 2: I-140 Immigrant Petition (4-12 months)

After PERM approval, your employer files the I-140 petition with USCIS. Regular processing takes 6-12 months. Premium processing (additional $2,805) gets a decision within 15 business days. Your priority date is locked in as the PERM filing date — this is the date that determines your place in the green card queue.

Step 3: Wait for Priority Date (0 to 10+ years)

This is where the timeline diverges dramatically by country. For applicants born in most countries, EB-2 and EB-3 categories are currently current — meaning zero additional wait. For India, the backlog stretches over 10 years for EB-2 and 12+ years for EB-3. Use our Green Card Calculator to check your specific priority date against the current Visa Bulletin.

Step 4: I-485 Adjustment of Status (8-24 months)

Once your priority date becomes current (or Dates for Filing allows), you file I-485. This grants access to an EAD work permit and Advance Parole while waiting for final approval. Current USCIS processing times for I-485 run 8-24 months depending on the service center and case complexity.

For most countries: 2-4 years total. For India: 12-15+ years. For China: 5-8 years.
